The rules for using this website and for connecting your accounts to Growth Desk. Your business’s service agreement with its provider governs the service itself.

01About these terms

These terms apply when you use growthdeskteam.com and when you connect an account to Growth Desk. By doing either, you agree to them. If you do not agree, please do not use the site or connect an account.

Growth Desk is a service for businesses. By connecting an account, you confirm you are acting for a business and not as a consumer.

02Who we are

Growth Desk is a trading name of Automation Wizards - FZCO, a free zone company registered in Dubai Silicon Oasis, Dubai, United Arab Emirates (licence number 53505). Registered address: Building A1, Dubai Digital Park, Dubai Silicon Oasis, Dubai, United Arab Emirates.

In these terms, “Growth Desk”, “we”, “us” and “our” mean Growth Desk, the business described above. “You” means the person using the site or connecting an account, and the business they act for.

03Your service agreement

Your business receives Growth Desk through its provider, under a service agreement with that provider. That agreement sets out what is included and both sides’ duties, and it governs the service.

These terms cover only this website and the accounts you connect. If these terms and your service agreement say different things about the service, your service agreement applies.

04Connecting your accounts

When you connect an account, such as Gmail, Outlook, a Facebook Page, an Instagram professional account or a WhatsApp Business number, you confirm that:

  • you are authorised to connect that account for the business;
  • the business allows Growth Desk to receive messages sent to that account and send replies from it, as described in our Privacy policy;
  • you will keep the sign-in details for your accounts secure.

You can disconnect any account at any time, from the account’s own settings or by emailing us. See Data deletion for the links. Disconnecting stops Growth Desk from using that account.

05Using Growth Desk lawfully

Your business is responsible for how it uses Growth Desk with its customers. In particular, you agree to:

  • follow the laws that apply to texts, calls and marketing email, including getting any consent the law requires before contacting people;
  • honour opt-outs, such as STOP replies and unsubscribe requests, straight away;
  • tell your customers how you use their data, as the law requires;
  • follow the rules of the platforms you connect, including Google, Microsoft and Meta;
  • only send offers and messages that are accurate and not misleading.

You can pause or stop messages at any time.

06Acceptable use

When you use this site or Growth Desk, you must not:

  • break any law or anyone else’s rights;
  • connect an account you are not authorised to connect;
  • send spam, harassing, unlawful or misleading messages;
  • try to get unauthorised access to the site, Growth Desk or our systems;
  • upload or send viruses or other harmful code;
  • overload, disrupt or attack the site or the service;
  • scrape or copy content or data using automated tools, except normal search engine indexing.

We may suspend access or disconnect an account if these rules are broken, and we will tell your provider.

07Availability

We work to keep this website and Growth Desk available and accurate, but we do not promise they will always be available, complete or free of errors. Connected platforms such as Google, Microsoft and Meta can change or limit their services, which may affect what Growth Desk can do. We may change, suspend or remove parts of the site at any time.

08Intellectual property

We, or our licensors, own this website and its content, including the Growth Desk name and logo. You may view the site and save pages for your own business use. You may not copy, republish or adapt it, or use our name or logo, without our written permission.

Your business’s messages and customer data stay yours.

10Limitation of liability

This website is provided free and “as is”. To the fullest extent the law allows:

  • we give no warranties about the site or its content;
  • we are not liable for any loss of profit, revenue, business, data or goodwill, or any indirect or consequential loss, arising from your use of the site or reliance on its content.

Liability for the Growth Desk service itself is set out in your service agreement.

Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence.

11Privacy

Our Privacy policy explains how we use personal data, including data from connected accounts. This website uses no cookies and no analytics.

12Law and disputes

These terms, and any dispute about them, this site or connected accounts, are governed by the law of the State of New York, United States.

If there is a dispute, we will first try to resolve it with you in good faith for 30 days. Any dispute not resolved is decided by binding arbitration. The International Centre for Dispute Resolution (ICDR) runs it under its International Arbitration Rules. The seat is New York, with one arbitrator, in English, and by video where convenient.

Either of us may still go to court for urgent relief or a small claim. Claims are brought individually, never as a class, and any jury trial is waived.

13Changes to these terms

We may update these terms from time to time. We will change the “Last updated” date at the top. The version on this page when you use the site or connect an account is the one that applies.
